This page defines your relationship with 2340322 Alberta Ltd. o/a House Work (hereinafter, “House Work”, “Company”, “we”, “us”, and “our”) as you purchase, use and interact with our services.  Our services include, but are not limited to: (i) use of Company websites bearing the root domain “housework.com” and social media accounts (the “Sites”) and the features, content, products and services provided by us when you visit, engage with, peruse or shop the Sites; (ii) use of our products or services; (iii) courses, events and forums offered by us; and (iv) use of software provided by us in connection with any of the foregoing (collectively, the “Services”). 

By using our Services, you agree to be bound by the Terms of Service (the “Agreement”) and to the collection and use of your information in accordance with our Privacy Policy. Please review this Agreement carefully to ensure that you understand each provision. The Terms of Service may change at any time without notice to you. You are solely responsible for reviewing and complying with the Agreement, as amended from time to time.

1. Use of our services

You may use the Services only if you can form a binding contract with House Work, and comply with this Agreement and all applicable local, provincial/state, federal and international laws, regulations and rules. 

You are eligible to contract with us and use our Services so long as you are not a child. For the purposes of this Agreement, a child is considered a person under the age of 13 years (or the minimum legal age in the child’s country to be able to consent themselves to the processing of their personal information if this age is older than 13 years old). 

Services may not be available to users that are previously removed from the Services. By using the Services, you represent and warrant that: (i) you have the full right, power and authority to enter into this Agreement and to fully perform all of your obligations hereunder; (ii) you are not bound by a legal agreement or other commitment that prevents you from entering into this Agreement; (iii) all account information is complete and accurate and will be maintained so that we can process your transactions and contact you as needed; and (iv) you will not violate the copyright, trademarks or other intellectual property rights of us or any third party.  

2. License and access

Subject to the terms and conditions of this Agreement and your payment of any applicable fees, you are hereby granted a limited, non-exclusive, non-transferable, non-sublicensable license to access and make personal and non-commercial use of the Services. This license does not include any resale or commercial use of any of our Services or Content (as defined in section 3), any downloading, copying or other use for the benefit of any third party, or any use of data mining, robots or similar data-gathering and extraction technologies. All rights not expressly granted to you in this Agreement are reserved and retained by House Work or its affiliates, licensors, suppliers, publishers, rightsholders, or other content providers. No Service, in whole or in part, may be reproduced, duplicated, copied, sold, resold, or otherwise exploited for any commercial purpose without our express written consent. We may terminate this license at any time for any reason.

3. Intellectual property 

Copyright. All content included in or made available through any Service such as text, graphics, logos, button icons, images, audio clips, videos, handbooks, digital downloads, data compilations, software, animation, music, sounds and choreography (“Content”) is the property of House Work, its affiliates or their content creators/suppliers and protected by Canadian and international copyright laws. The compilation of all Content included in or made available through any Service is the exclusive property of House Work and protected by Canadian and international copyright laws.You do not acquire any ownership rights in and to Content that is accessed or downloaded by you from any of our Sites, regardless of whether payment is rendered for such use. 

Trademarks. House Work is our trademark.In addition, graphics, logos, page headers, button icons, scripts, and service names included in or made available through any Service are trademarks of House Work in Canada and other countries. House Work trademarks may not be used in connection with any product or service that is not ours, in any manner that is likely to cause confusion among customers, or in any manner that disparages or discredits us. All other trademarks not owned by House Work or its affiliates that appear in any Service are the property of their respective owners, who may or may not be affiliated with, connected to, or sponsored by us. You may not use any of our trademarks, logos, or other proprietary information (including images, text, page layout, or form) or use any meta tag or any other “hidden text” utilizing House Work’s name or trademarks without our prior written consent.

4. Payments and pricing

Online purchases made through our Shopify store are processed using Shopify Payments and PayPal, subject to their respective terms and conditions. Online purchases will be charged in the currency that appears on the Sites accessed by you. We are not responsible for any fees, changes, exchange rates or additional charges levied by individual financial institutions or credit card companies. Prices are subject to change.

House Work does not collect, store or have access to your credit card information. We have fully outsourced all cardholder data functions to Shopify and PayPal; both payment processors are PCI DSS compliant.

5. Privacy and security

Please review our Privacy Policy to understand your legal rights and our practices with respect to the collection, use, disclosure and storage of your Personal Information when you engage with us and use our Services. 

While your privacy is our priority, information transmitted over the internet is generally not secure.  As a result, we do not guarantee the security of any communication to or from our Sites.

6. Electronic communications, feedback, comments and other content

When you use any of our Sites or send emails, text messages, and other communications from your desktop or mobile device to us, you may be communicating with us electronically. You consent to receive communications from us electronically, such as emails, texts, mobile push notifications, or notices and messages on our Sites or through the other Services. You are able to retain copies of these electronic communications for your records. You agree that all agreements, notices, disclosures, and other communications that we provide to you electronically satisfy any legal requirement that such communications be in writing.

If you choose to give us feedback, such as suggestions to improve our Services, we may (or may not) act on your feedback without obligation to you.  Your suggestions and ideas, once shared with us will be owned by us. Before we share your feedback publicly on any of our Sites, we will seek your permission and also give you the option to remain anonymous.

Opinions and comments that are shared publicly by users of our Sites are theirs alone and do not represent our opinions or views. We do not monitor our Sites for unlawful, inappropriate or offensive content and we do not endorse or guarantee the accuracy, completeness, non-infringement of such third party content. We assume no responsibility or liability which may arise from the third party content, including but not limited to claims for defamation, libel, slander, infringement, invasion of privacy and publicity rights, obscenity, pornography, profanity, fraud or misrepresentation. That said, we reserve the right to delete or block any communications, posts, content or materials at any time in our sole discretion. 

If you observe online activity, engagement or content on our Sites that you believe to be in contravention of the Terms of Service or that causes you concern, please connect with us (see Contact Us section below). 

7. Respect others

Respect and civility are non-negotiables when you communicate with us, post comments on our Sites, engage with our community or use our Services. Our ask is that you follow these basic rules of conduct:

  • Comply with applicable laws, including human rights laws;
  • Respect the rights of others, including privacy and intellectual property rights;
  • Don’t abuse or harm others or yourself (or threaten or encourage such abuse or harm) – for example, by misleading, defrauding, defaming, disparaging, bullying, harassing, discriminating, illegally impersonating, sexually exploiting, inciting violence or stalking others; and
  • Don’t abuse, harm, interfere with or disrupt the Services – for example, by accessing or using them in fraudulent or deceptive ways; spamming; introducing malware, hacking or bypassing our systems or protective measures; modifying, reverse engineering, decompiling or dissembling software; sharing credentials; or facilitating unauthorized access.

8. Links to third party websites 

We provide links to websites of affiliated companies and certain other businesses, such as Amazon.ca/.com (each a “Linked Site”).  If you purchase any of the products or services offered by affiliates and businesses, you are purchasing directly from those third parties, not from House Work. We are not responsible for examining or evaluating, and we do not warrant any of the offerings of, any of these businesses. We shall have no responsibility or liability to you in connection with any Linked Site, including the availability, accuracy and reliability of any such Linked Site and its content. Further, Linked Sites are provided as a convenience, and do not imply our endorsement of the products, services, materials, contents or statements thereon. When you are re-directed to a Linked Site, our Terms of Service no longer apply; instead you will be governed by the terms and conditions and privacy policies of the third party that owns such Linked Site. Linked Sites are accessed and used at your own risk.

9. Hyperlinking to our Sites and Content

Except as expressly permitted in this Agreement, all links to our Sites and Content must be approved by us in advance of you publishing any such links. Requests for permission or questions regarding hyperlinking can be directed to us at: [email protected].   

If you are a government agency, search engine, news or social media outlet, online directory or an influencer/affiliate/brand approved by us, you are granted a non-exclusive, world-wide, royalty-free, revocable license to hyperlink to our Sites. You may link to our home page or Content using “House Work” or the corresponding URL as long as the link: (a) is not in any way deceptive; (b) does not falsely imply that we sponsor, endorse or approve you or your products and/or services; (c) fits within the context of your site. 

No use of our logos, images, artwork or other branded materials will be allowed for linking purposes unless you and us have entered into a trademark license agreement. 

10. Disclaimers; Limitations of Liability

All Content provided on our Sites is intended for general informational purposes only, and should not be relied upon or used to replace the manufacturer’s warnings, product labels, instruction manuals, warranties or the advice of a qualified professional. 

Our Sites provide educational Content that includes cleaning hacks (aka. tips) for your home and possessions. These hacks are suggestions only, and include some of our favourite cleaning products, tools and methods that have withstood the test of time and have proven effective in the homes we clean. It is important to note that not all homes are the same. Each home contains floors, fixtures, furniture and appliances made up of different materials. Depending on the composition, property will react differently to different cleaning products, tools and methods. That is why we strongly encourage you to read the labels of your cleaning products and possessions as well as the manuals and manufacturer’s warranties of your property before you try any of our hacks at home. You will want to do your homework and satisfy yourself that the cleaning hacks are safe and appropriate for your home and possessions. Always do a small spot check first. You are solely responsible for your own diligence, assessments, cleaning and outcomes.  We do not guarantee results and are not responsible or liable for any damages that arise out of the use of our Sites or Content. You clean your home at your own risk.

HOUSE WORK, ITS AFFILIATES AND THEIR CONTRACTORS, LICENSORS AND SUPPLIERS MAKE NO REPRESENTATIONS OR WARRANTIES, EXPRESS OR IMPLIED, ABOUT THE SUITABILITY, RELIABILITY, AVAILABILITY, TIMELINESS, SECURITY OR ACCURACY OF THE SERVICES, THE SITES AND THE CONTENT AND INFORMATION THEREON WHICH ARE PROVIDED “AS IS” AND “AS AVAILABLE”. HOUSE WORK, ITS AFFILIATES AND THEIR CONTRACTORS, LICENSORS AND SUPPLIERS HEREBY DISCLAIM ALL WARRANTIES AND CONDITIONS OF ANY KIND WITH REGARD TO THE SERVICES, THE SITES AND THE CONTENT AND INFORMATION THEREON, INCLUDING ALL IMPLIED WARRANTIES OR CONDITIONS OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE AND NON-INFRINGEMENT. NO STATEMENT OR INFORMATION, WHETHER ORAL OR WRITTEN, OBTAINED FROM HOUSE WORK IN ANY CIRCUMSTANCE SHALL CREATE ANY WARRANTY NOT EXPRESSLY AND EXPLICITLY SET FORTH IN THIS AGREEMENT. THE SITES AND CONTENT THEREON MAY INCLUDE INACCURACIES OR TYPOGRAPHICAL ERRORS. YOU EXPRESSLY AGREE THAT YOUR USE OF HOUSE WORK SERVICES AND CONTENT IS AT YOUR SOLE RISK.

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, IN NO EVENT SHALL HOUSE WORK AND ITS AFFILIATES, SERVICE PROVIDERS, LICENSORS OR SUPPLIERS BE LIABLE FOR ANY DIRECT, INDIRECT, PUNITIVE, INCIDENTAL, SPECIAL, CONSEQUENTIAL, EXEMPLARY OR OTHER TYPE OF DAMAGES, INCLUDING WITHOUT LIMITATION DAMAGES FOR LOSS OF USE, DATA, REVENUE OR PROFITS, DAMAGES TO PROPERTY OR UNSATISFACTORY RESULTS ARISING OUT OF OR IN ANY WAY CONNECTED WITH THE USE OR PERFORMANCE OF THE SERVICES, USE OR MISUSE OF THE SITES OR CONTENT THEREON, OR THE DELAY OR INABILITY TO USE THE SITES. THE FOREGOING EXCLUSION OF LIABILITY APPLIES WHETHER A CLAIM IS BASED IN CONTRACT, TORT, INCLUDING NEGLIGENCE, STRICT LIABILITY, OR OTHER LEGAL OR EQUITABLE THEORY AND REGARDLESS OF WHETHER SUCH DAMAGES WERE FORESEEABLE OR WHETHER WE HAVE BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES. SINCE THE LAWS OF CERTAIN JURISDICTIONS (INCLUDING QUEBEC’S CONSUMER PROTECTION ACT) DO NOT ALLOW THE EXCLUSION OR LIMITATION OF LIABILITY FOR CERTAIN DAMAGES, THE ABOVE DISCLAIMERS, EXCLUSIONS AND LIMITATIONS MAY NOT APPLY TO YOU.

NOTWITHSTANDING ANY OTHER TERM OF THIS AGREEMENT, IN THE EVENT THAT HOUSE WORK IS LIABLE FOR ANY LOSS, HARM OR DAMAGE, YOU AGREE THAT THE AGGREGATE LIABILITY OF HOUSE WORK AND ITS AFFILIATES AND THEIR RESPECTIVE OFFICERS, DIRECTORS, EMPLOYEES, AGENTS, CONTRACTORS, LICENSORS AND SUPPLIERS SHALL BE LIMITED TO ONE HUNDRED ($100) CANADIAN DOLLARS. 

11. Indemnification

You understand and agree that you are personally responsible for your behavior on the Sites. You agree to indemnify, defend and hold harmless House Work, its affiliates and their officers, directors, employees, agents, contractors and licensors from and against all claims, losses, expenses, damages and costs (including reasonable legal fees) resulting from or arising out of your use or misuse the Sites or the Content, or any breach of this Agreement by you. 

12. Reservation of our rights

With respect to the provision of Services, we reserve all rights to take the following actions, at any time and without notice or liability to you:

  • Modify, add or delete any Terms of Service;
  • Modify, add or remove portions of the Sites and Content at any time;
  • Alter the pricing of any Service;
  • Discontinue or cancel Services (subject to refund policy);
  • Offer Services exclusively online;
  • Refuse to sell to any person or organization and to limit quantities per person, per household, per order or to otherwise impose restrictions;
  • Terminate, block or restrict your access to the Services on account of you breaching this Agreement; 
  • Delete content that is posted by you that is illegal, harmful, offensive, or contrary to this Agreement; and
  • Remove any Linked Site from our website, or request the deletion of a hyperlink to our Site that appears on your website.

In addition to the foregoing actions, if we determine in our sole discretion that you have breached this Agreement, we shall be entitled to enforce all rights available to us under this Agreement at law and in equity.

13. Governing law

This Agreement is governed by and construed in accordance with the laws of Alberta, and the federal laws of Canada therein, regardless of conflict of laws rules. All disputes relating to or arising out of this Agreement or any related Services will be resolved in the courts of Calgary, Alberta, Canada, and you and House Work consent to the exclusive jurisdiction of those courts. 

14. About these terms

By law, you have certain rights that cannot be limited by this Agreement. This Agreement is in no way intended to restrict your legal rights.

This Agreement describes and governs our relationship with you and you only. It does not create any legal rights for other people or organizations, even if others benefit from our relationship under these Terms of Service.

If these Terms of Service conflict with a separate agreement that you have entered into with us in respect of a particular Service, the provisions of the other agreement will prevail and govern you and us to the extent of the conflict or inconsistency; otherwise the remaining Terms of Service will continue to apply and supplement the provisions of the separate agreement.

If it turns out that a particular provision is not valid or enforceable, as determined by a court of competent jurisdiction, this will not affect any other provision set out in this Agreement.

You and us are independent contractors, and nothing in this Agreement will create an agency, employment or fiduciary relationship. 

If you do not follow or abide by this Agreement, and we choose not to take action, that does not mean that we are giving up any rights that we may have such as taking action against you in the future. 

We may update these Terms of Service (i) to reflect changes in our Services or how we do business; (ii) for legal, regulatory or security reasons; or (iii) to prevent abuse or harm. If you do not agree with any portion of the updated or amended Terms of Service and no longer wish to be bound by this Agreement, you shall immediately stop using the Services.

We have the right to assign this Agreement to a third party in relation to a merger, acquisition or corporate reorganization by operation of law or otherwise.
